Safety and your vehicle
You are carrying a child under 14 in your car. Who is responsible for making sure they use the correct seat belt or child restraint?
- The driver of the vehicleCorrect
- The child themselves
- The child's parent, even if they are not in the car
- Nobody, as it is only advice for young children
Why?
The law puts the duty on the driver, not the child. Rule 99 to 102 of The Highway Code says the driver is responsible for making sure that children under 14 use the correct child restraint or seat belt for their height and weight. Adults over 14 are responsible for wearing their own belt.
